"The issue, plainly put, is whether a suspect's silence can constitute waiver of his Miranda rights. The Michigan Supreme Court said yes, the 6th circuit said no, and now the U.S. Supreme Court, by a 5-4 vote, has said yes. Berkeley's Charles Weisselberg calls the decision the most important Miranda decision in a decade. SCOTUSblog says the opinion in Berghuis v Thompkins decisively tilts the warnings procedure toward the police, but that "it probably will take years for police to decide how, in the real world, and whether, in fact, they want to take advantage of the new ruling."
